Functions, Duties of People’s Committee of Co Do district

I. FUNCTIONS:

People’s Committee, which is elected by People’s Council, is the executive body of People’s Council, the administrative body of the State in localities, being responsible to People’s Council at the same level and higher authorities.

People’s Committee of Co Do district is responsible for implementing the Constitution, law, texts of higher authorities and resolution of People’s Council at the same level to ensure the implementation of policies, measures in developing socio-economy, reinforce national defense, security and other policies on areas.

People’s Committee implements the function of state management in localities, contributing to ensuring unanimous direction, management in administrative system of the State from central government to grassroots level.

II. DUTIES, AUTHORITIES:

a) In the field of economy, District People’s Committee implements the duties and authorities below: 

1. Set up the annual plan to develop socio-economy and submit it for District People’s Council’s passing to have People’s Committtee’s approval; organize and inspect the implementation of this plan;

2. Set up the incomings’s estimate of State’s budget on area; the incomings and outgoings’ estimate of local budget, budget allocation project on each level; local budget finalization reports; set up the estimate on adjusting local budget in essential cases submitting District People’s Council to decide and report to People’s Committee, financial bodies in the direct and higher authorities; 

3. Organize the implementation of local budget; guide, control Commune People’s Committee in setting up, implementation of budget and control resolutions of Commune People’s Council on the implementation of local budget as provided for by the law;

4. Ratify socio-economic plan of Communes and townships.

b) In the field of agriculture, sylviculture, pisciculture, irrigation and soil, District People’s Committee implements the duties and authorities below:

1. Set up, submit District People’s Council through programs which encourage the development of agriculture, sylviculture, pisciculture in localities and organize to operate these programs;

2. Direct Commune People’s Committee to implement measures of economic restructuring, agriculture development, forest protection, afforestation and forest products exploitation, development in fishing, aquaculture and aquatic products processing;

3. Implement allocation of land, lease of land, land recovery in case of individuals and family households, resolve land disputes, inspect land as provided for by the law;

4. Aprrove land use zoning, land use plans of Commune People’s Committee;

5. Set up irrigation zoning; organize dykes protection, small and medium irrigation works; manage irrigation network on areas as provided for by the law.

c) In the field of industry, handicraft, District People’s Committee implements the duties and authorities below:

1. Join with Provincial People’s Committee in setting up zoning and plans of developing industry, handicraft on district areas;

2. Construct and develop facilities on industry, handicraft, service in communes and townships;

3. Organize the implementation of setting up and developing traditional trade villages, producing products with consuming and exporting values; developing processing facilities in agricultural, forest and aquatic products and other industrial facilities according to the direction of Provincial People’s Committee.

d) In the field of construction, transportation, District People’s Committee implements the duties and authorities below:

1. Organize the making, submitting for approval of the authorities on township, rural populated point construction zoning on dictrict areas; control the implementation of approved construction zoning;

2. Control, exploit, use traffic works and infrastructure to various levels;

3. Control the construction, issue of construction certificate and check law compliance on construction; organize the implementation of policies on residential houses; control residential land and land fund in State’s possession on areas;

4. Control the exploitation, production, trade of building materials to various levels of Provincial People’s Committee.

e) In the field of commerce, service and tourism, District People’s Committee implements the duties and authorities below:

1. Set up, develop networks of commerce, service, tourism and check the compliance of State regulations on commercial, service and tourist activities on district areas;

2. Check the implementation of safety and hygience rules on commercial, service and tourist activities on district areas;

3. Check the  compliance of State regulations on commercial, service and tourist activities on district areas;

g) In the field of education, health, society, culture, information and physical training, District People’s Committee implements the duties and authorities below:

1. Set up programs, projects on culture, education, information, physical training, health, broadcast on district areas and operate after being approved by authorized level;

2. Organize and check the implementation of State regulations on universalized education, control primary schools, secondary schools, technical schools; organize kindergarten; implement socialized education policies on areas; direct the elimination of illiteracy and comply regulations on teacher standards, examination regulations;

3. Control decentralized public works; guide cultural movements, activities of culture-information, physical training center; protect and promote values of historical-cultural monuments and famous landscapes controlled by localities;

4. Implement health achievement developing plan; control medical center, medical stations; direct and check people’s health protection; epidemic disease prevention; protect and take care of helpless old peoples, handicaps, orphans; protect and take care of others and children; obey population and birth-control policy;

5. Check the law compliance in activities of private medical, pharmatical facilities, printing, publishing facilities;

6. Organize, direct vocational training, supply jobs for employees; organize the implementation of poverty-alleviation movements; guide charitable, humanitarian activities.

h) In the field of science, technology, resources and environment, District People’s Committee implements the duties and authorities below:

1. Implement scientific, technological progress applying measures to serve the production and people’s life in localities;

2. Organize the implementation of environment protection; natural calamities, flooding prevention and repair the damages;

3. Organize the implementation of law on measuring standard and product quality; check products and commodities quality on district areas; prevent the production and circulation of counterfeits and low-quality goods in localities.

i) In the field of national defence, security and society order, safety, District People’s Committee implements the duties and authorities below:

1. Organize movement for the public to participate in building armed forces and national defence; implement plans of building district defence areas; control the reserve forces voluntarily calling up for military; direct the setting up civil defence force, civil defence force training;

2. Organize the military service registration, medical examination; decide the enlistment, transfer, cancellation, exemption on military service and handle violation cases according to the law;

3. Organize the implementation of ensuring security, society order and safety, building strong district people’s police force, protecting state secrets; implementing preventing measures on crimes, social evils and other violations in localities; 

4. Direct and check the implementation of law compliance on inhabitant control, residence and travelling of foreigners in localities;

5. Propagandize, educate, campaign people to participate in the movement of security, society order and safety protection.

k) In the implementation of nationality policy and religious policy, District People’s Committe implements the duties and authorities below:

1. Propagandize, educate, popularise policies, law on ethnic minorities and religion;

2. Organize the implementation of assigned tasks on programs, plans, projects of provincial socio-economic development in ethnic minorities regions, far regions, spectacularly difficult regions;

3. Direct and check the implementation of nationality policy and religious policy; freedom right on religious beliefs, citizen’s having or not having religion in localities;

4. Decide on preventing measures on violations of religious belief’s freedom or take advantage of religious belief to break the law and State’s policies according to the law.

In the law implementation, District People’s Committee implements the duties and authorities below:

1. Direct, organize the law propagation, education, check the Constitution, law, texts of state body in higher level and resolutions of District People’s Council compliance;

2. Organize the implementation and steering Commune People’s Committee to carry out the measures of protecting properties of the State, socio-political organizations, social organizations, economic organizations; protecting lives, freedom, honour, properties, rights and other legal benefits of citizen;

3. Direct the implementation of birth, death and marriage management on areas;

4. Organize, direct the implementation of execution according to the law;

5. Organize, direct the implementation of state inspection; organize the treatment to the people, handle timely complaints and accusations and petitions of citizen; guide, direct mediaton in communes and townships.

l) In the authority buiding and boundaries of administrative units control, District People’s Committee implements the duties and authorities below:

1. Organize the implementation of electing National Assembly’s representatives, People’s Council’s representatives according to the law;

2. Set the rules for the organization and detail duties, authorities of specialized bodies in People’s Committee according to the instruction of higher People’s Committee;

3. Control the organization, personnel, labour, salary according to the decentralization of higher People’s Committee;

4. Control documents, points, landmarks, boundaries of administrative units map of the district;

5. Set up the project to form, join, separate, adjust boundaries of administrative units in localities and submit for District People’s Council passing to be considered and decided by higher authority.

6. Set up urban developing zoning of the district and submit for District People’s Council passing to be approved by higher authority.

7. Implement resolutions of People’s Council on overall constructing and urban developing zoning of the district on the basis of general zoning, plans of constructing urban infrastructure, measures of ensuring public order, traffic, fire and explosion prevention, environment and urban landscape protection; measures of urban inhabitants control and inhabitants’ life organization on areas;

8. Implement the control and check on using state’s fund on areas according to the decentralization of Government; organize the implementation of decisions on handling violations in construction, land transgression according to the law;

9. Control, check in using assigned public works on areas; building state-owned high school; building and using public works, lighting, drainage, traffic within the city, traffic safety, urban hygiene in localities;

10. Control culture-information facilities, physical training of communes and townships belonged to the province; protect and promote the values of cultural-historical monuments and landscapes controlled by the district.
